Data Controller

The controller of personal data of Ownetic users is the owner and operator of the platform – Modulus Sp. z o.o. based in Krakow at ul. Karmelicka 35/5, with a tax identification number (NIP) 6761188405, and REGON number 351093142, registered in the Register of Entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register under the number: 0000377707.

 

Purposes and legal bases and the period during which your personal data will be processed

1.  Purpose of processing: performance of the contract between you and the data controller (such contract is concluded by accepting the terms and conditions during registration at Ownetic),  including providing services under Ownetic, providing them with security, analyzing and improving, as well as customizing services to your needs
Basis of processing: Article 6 item 1 point b) GDPR – necessity to perform the contract the User is a party to
Processing period: until expiration of a given contract between you and the data controller, provided that these data may sometimes be processed even after the contract expires, but only if it is permitted or required under applicable law, e.g. processing for statistical purposes, billing or to pursue claims

2. Purpose of processing: creating statistics, marketing (including analyzing and profiling data for marketing purposes) the controller’s products and services
Basis of processing: Article 6 item 1 point a), f) GDPR – reasonable interest of the Controller.
Processing period: until an effective objection is made

3. Purpose of processing: marketing (including sending newsletters, analyzing and profiling data for marketing purposes) regarding products and services
Basis of processing: Article 6 item 1 point a) – voluntary consent
Processing period: until the consent is withdrawn

Method of data collection

We collect information by:

  • using the information you have voluntarily entered while registering and using the account. This information includes: name and surname, e-mail address, profile photo
  • information about third parties entered and submitted by Ownetic users if an Ownetic user invites/recommends the Ownetic platform to a third-party using the platform’s functionality. In the events, when the user provides the third-party personal data to Ownetic, then the user declares that he has the third party’s consent to the processing of his personal data by Data Controller in connection with the inviting him to Ownetic through the functionality available on the platform
  • by storing information in the end user’s telecommunications terminal device in the form of “cookies”
  • by collecting logs to the server.

Your rights in connection with the processing of data by the Controller

Providing personal data is voluntary; you have the following rights in relation to the data processing:

  • the right to access your data
  • the right to rectify data
  • the right to delete data
  • the right to move data
  • the right to file a complaint with the supervisory body dealing with the protection of personal data.

If your data are processed based on consent, then you also have:

  • the right to withdraw consent to processing at any time, without affecting the lawfulness of the processing carried out on the basis of consent prior to withdrawal

You also have the right to object to the processing of your personal data, in particular for the purposes of direct marketing, including profiling.

Transferring data to another operator

Data may be transferred to another entity, e.g. IT service providers, marketing agencies, etc. who will process data on behalf of the controller and on the basis of a contract concluded with them.

The data controller only uses the services of such processors that provide sufficient guarantees so as to implement the appropriate technical and organizational measures to ensure the security and protection of the rights of data subjects.

Your data will never be sold, and their transfer to other operators may only be made in connection with the provision of services via Ownetic.

 

Data storage location

The collected personal data is stored in the European Economic Area (“EEA”), but they can also be sent to a country outside this area and processed there. Every operation transferring personal data is carried out in accordance with applicable law. If the data is transferred outside the EEA, the controller shall apply the Standard contractual clauses and the Privacy Shield as safeguards for countries where the European Commission has not found an adequate level of data protection.

 

Links to other websites

The Ownetic platform may contains external links, e.g. links to Facebook, Google through which you can register and log in to Ownetic. In the event of using links to other websites, we are not responsible for the privacy practices of these websites. We encourage you to become familiar with the privacy policy in force after switching to other websites and before providing your personal data. This privacy policy only applies to Ownetic platform.

 

Personal details of children

Ownetic requires everyone to be at least 16 years old and to have sufficient capacity
to perform legal actions in the area, which requires the use of Ownetic services, including ability to provide consent to data processing; therefore the controller does not process personal data of anyone under the age of 16.

 

Updates of the Privacy Policy

You may need to update the Privacy Policy in the future. Its latest version will always be available on the Ownetic platform.

 

“Cookies” policy

At the Ownetic platform, we use the so-called “cookies” and similar technologies that, by saving short text information on the user’s device, allow learning about their behavior and how they use the site, which in turn gives the best possible customization of the platform to their needs, and allows creating statistics.

Storing or accessing information does not cause any configuration changes in the User’s device or in the software installed on it.

Types of “cookie” files and purposes of storing and accessing information:

  • Essential – enable the use of Ownetic services, e.g. files that allow maintaining the session of a logged-in Ownetic user, remembering the contents of the user’s account
  • Functional -allow the site to remember user-selected settings that change the appearance or functioning of the platform, e.g. the preferred language or region, in which the user is located
  • Performance – allows collecting information about the performance of the platform and how the user uses it
  • Statistical – allow creating statistics and understanding how users use the platform by collecting anonymous information
  • Advertising – these allow delivering and displaying advertising materials adjusted to the user’s interests.

 

The Ownetic platform uses session cookies, which are created and exist only during the browser’s session; these are necessary for the proper operation of individual elements of the platform, and permanent “cookie” files that are stored in the User’s device for the time specified in the file parameters, or until they are removed by the User.

We use both our “cookies” and third-party “cookies” to collect statistics and user data in aggregated and individual form, as well as analytical tools to optimize our site and present an offer that is interesting to the User.

 

You can give consent to “cookie” access using the web browser settings on your device. You can change the level of file access at any time, although blocking “cookie” access completely may prevent using the website, or some of its features.

To change “cookie” access in the most popular web browsers:

  • Google Chrome – click on the menu in the Settings tab > Show advanced settings. In the “Privacy” section, click the “Content settings” button. In the “Cookies” section, you can change the following “cookies” settings:
    • deleting cookie files,
    • blocking cookies by default,
    • allowing cookies by default,
    • saving cookie files and website data until closing the browser by default,
    • determining exceptions for cookies from specific sites or domains.
  • Internet Explorer 11 – select from the browser menu: Tools > Internet Options > Privacy, Sites button. Then use the slider to set the level, confirm the change with “OK”.
  • Mozilla Firefox – select from the browser menu: Tools > Options > Privacy. Activate the box in Firefox: “will use user settings”. Then either select the “Accept cookies” box or not.
  • Opera – open the browser menu: Tools > Preferences > Advanced. Then either select the “Accept cookies” box or not.
  • Safari – select “Preferences” in the menu and click the “Security” icon. Then set the security level in the “Accept cookies” area.
